Besides understanding the concept of BL in import and export, it is also necessary to understand the function of BL. BL has 3 main functions, which are:

  • One, is considered as a proof of receipt of goods between the carrier and the shipper for the purpose of confirming receipt of the goods.
  • Second, it is also a documentary proof of title to the goods mentioned on the bill of lading. Whoever has the original bill of lading, the title of the goods mentioned on the original bill of lading belongs to him and this original bill of lading can be traded.
  • Third, B/L is considered as a proof of the contract of carriage and has legal validity. When there is a dispute between the issuer and the holder of the bill of lading, they will rely on the BL to resolve

Currently, there are countless types of original bills of lading, which are created depending on the purpose of use and the type of goods that the two parties exchange. However, if divided into 4 ways, there will be the following types of Bill of Lading applications:

According to the calculation of ownership of goods:

Direct bill of lading (Straight B/L): On the original bill of lading, the name and address of the consignee will be clearly indicated and the goods will only be delivered to the designated consignee.

To order B/L: The back side of this original bill of lading will be endorsed

  • To order of named person: In the column “Consignee” or “To order of” there will be information of the person, company, organization recorded and the goods will be delivered according to the order of that person, company or organization by they endorse on the back of the original bill of lading, and at the same time write the name of the consignee.
  • To order of a issuing bank: Similar to "To order of a named person", however, the endorsement on the back of the original bill of lading is the bank.
  • To order of shipper: The consignee will be the person nominated by the endorser, ie at the order of the shipper or the owner.

Anonymous bill of lading (To bearer B/L): In the original bill of lading, the name of the consignee is not mentioned, so the goods will be delivered to the bearer of the anonymous bill of lading.

According to the goods note:

If based on the goods note, they can be divided into 2 types of B/L, which are:

  • Perfect Bill of Lading (Clean B/L): The goods listed on the original bill of lading are in good condition in transit
  • Incomplete bill of lading (Unclear B/L or dirty B/L): Before the carrier had problems such as rancid smell, dampness, etc.

According to the transportation and transportation journey

Based on the shipping and transportation journey, there are different types of Bill of lading:

  • Direct Bill of Lading (Direct B/L): If the goods do not need to be conveyed during the journey from the point of origin to the destination, this original bill of lading will be issued.

There are 2 types of original bills of lading, based on the time of loading and unloading on the ship, which are:
